Plaintiff’s lawyers wanted to suspend case after argument about his identity came unstuck in Canberra high court

A high court case seeking to challenge indefinite detention will continue despite attempts by the plaintiff’s lawyers to have it referred back to a single judge after their arguments on his statelessness appeared to come unstuck under questioning.

The case was brought on behalf of an allegedly stateless man, referred to in court as plaintiff M47, who has been held in immigration detention for nine years. His lawyers argue that he has almost no prospect of release or removal from Australia.
